GENERAL CONTRACTING CONDITIONS

These general contracting conditions will expressly regulate the commercial relations between TINN AJE. (hereinafter, Flyoutshop) and the users who make the purchase of the products offered through this website.

Users are informed that Flyoutshop reserves the right to modify these general contracting conditions at any time, whatever the foreseen ends, respecting in any case the general conditions in force at the time of the contracting or purchase made by the user.

These conditions have been prepared in accordance with the provisions of Law 34/2002, on services of the information society and electronic commerce, Law 7/1998 on General Contracting Conditions, Royal Legislative Decree 1/2007 by the one that approves the revised text of the General Law for the Defense of Consumers and Users in its last modification contained in Law 3/2014 of March 27, Law 7/1996 on the Regulation of Retail Trade and how many legal provisions are of application.

The user, with the acceptance of the terms and conditions, declares to know and accept the procedures set forth herein as necessary to proceed with the purchase.

INFORMATION PRIOR TO PURCHASE

All users will be able to view within the website, classified by categories and sub-categories, the totality of products offered for purchase. By clicking on each of them, the user will be able to access a complete product file where a small description, its availability and price will be indicated. Users are informed that all the data provided in the description of the products are made based on the information provided by their suppliers.

All prices are shown in euros and include applicable VAT and / or any other applicable taxes. Said prices will be current at all times, except for possible manifest typographical errors. Transportation is not included in the prices shown for the products, its cost being broken down later at the time of completion of the purchase.

The user is informed that the product acquired through this website may suffer, due to the manufacturer’s availability, non-substantial modifications in the components, characteristics or benefits of the batch that comprise it, as long as they do not represent a demerit of the qualities and advertised benefits.


PURCHASE SYSTEM

The procedures to carry out the acquisition of products will be those shown on the screen at all times and described in these General Conditions. Users can register as members of Flyoutshop during the product purchase process to enjoy promotional benefits. In the same way, the user is provided with a purchase method without the need to register with Flyoutshop, in which an email address will be requested.

To proceed with the purchase of the products, the user must click “Buy” on each product. As the user selects what they want, they will be able to preview in the upper right part of the website the “Cart” or “Basket” with the products pending payment, which will be updated as products or services are added, as well as the costs of transport. If the user wants to see his order in more detail, he can click on “Cart” and he will be directed to another screen where he can see a summary of the selected products. From there you can choose to continue shopping or confirm your order.

In the summary screen of the “Cart” or “Basket”, the user may make use of a discount voucher that Flyoutshop has given him derived from a promotion, raffle or other circumstance. To validate it, you must click on “Redeem Code” and you will see the discount in the price breakdown, as long as it is still valid according to its particular conditions.

When the user has completed his shopping list, he must click the “Confirm order” button that he will find at the bottom of the breakdown of his purchase. From this moment on, you must fill in the information as requested and select, where appropriate, the delivery and billing address, shipping method, as well as indicate the payment method you wish to use.

PAYMENT SYSTEM

Payment can be made through bank transfer, cash on delivery, credit or debit card or PayPal. The user will be able to choose the payment method at the end of the purchase, and both payments will be subject to the following conditions:

Payment by credit card will be made through a payment gateway managed by a bank with a secure server certified according to the SSL protocol. The bank details entered are encrypted and transmitted securely to the services of the bank and, subsequently, are verified with the issuing bank to avoid possible fraud and abuse. Flyoutshop does not have the bank details or the credit or debit card used by the user to make the purchase.

When the amount of the purchase has been charged fraudulently or improperly using the payment card number, it will entitle the buyer to demand the immediate cancellation of the charge. However, if the purchase had actually been made by the cardholder buyer and the return demand was not a consequence of having exercised the right of withdrawal or resolution, the latter will be obliged to the employer to compensate the damages caused as consequence of said cancellation.

Once the payment method has been selected and the order completed, Flyoutshop will always send an email to the user confirming the order.

SHIPPING ORDERS

The shipping costs are proportional to the weight, the destination of the package and the shipping method and will be borne by the buyer. These expenses will be displayed in the cart before proceeding with the purchase.

Flyoutshop emphasizes the responsibility of the user to enter a complete and correct delivery address. At the time of departure of the distribution order, the customer will be informed of this fact and the carrier will activate the tracking functions to guarantee delivery.

Flyoutshop makes shipments throughout the Spanish territory and the rest of European countries. The rest of the countries are excluded from the current shipping policy on the web.

Users are informed that there will be no delivery service on Saturdays, Sundays and holidays. Therefore, these days count as non-business days. Orders are prepared and shipped on the same business day, provided it is placed before 3:00 PM. If it is done after this time, they will be sent on the next business day, starting the delivery period from the date of preparation.

EXCEPTIONS IN DELIVERY TIMES

During the special offers on the Flyoutshop website, the delivery time may be longer than usual.

Flyoutshop will not assume any responsibility for delay in the delivery of orders when this delay is the sole fault of the buyer or the authorized person.

The client assumes the risks of deterioration, impairment, damage and loss of the products of the order from the moment they are delivered in accordance with the procedure regulated in these Terms and Conditions. The client will be responsible for the storage and conservation of the products under the conditions that, where appropriate, are established in their labeling or technical data sheet.

If an item is not in stock at the time of ordering, we will let you know and confirm the date when it will be available again or we will propose an equivalent replacement product.

SEND CONDITIONS

The customer will be responsible for verifying the content and status of the merchandise at the time of delivery. Once your signature has been accepted and consigned on the copy of the delivery note to be returned to the carrier, you will have expressed your agreement on what was received and renounced any subsequent claims on the suitability and identity of the merchandise requested and received. In the case of verifying the customer at the time of delivery errors in the merchandise received or that it is visually damaged, you must record these circumstances on the carrier’s delivery note and you must inform us of these facts within 24 hours.

TAXES AND OTHER CHARGES

In the case of import fees and / or customs procedures, these expenses will be borne by the buyer.

RETURN POLICY

The customer will have a period of up to fourteen (14) calendar days from receipt of the product to exercise their right of withdrawal, without indicating any reason.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract through an unequivocal statement to the email address; flyoutshop@gmail.com .


In case of withdrawal on your part, all payments received from you will be returned to the client in the same form of payment in which they were made. The shipping costs to make the return will be borne by the user. Returned products must be in normal condition (with its original packaging and unused or tampered with). It will be necessary to attach a copy of the invoice. Before returning the Product, the Customer must ensure that it is properly protected and sealed so that it does not suffer any damage during transport.

If the cause of the return is that the product is defective or does not correspond to what was ordered, Flyoutshop will bear the costs of the return and the new shipment. If the reason is that the order does not satisfy you, we will refund the amount, but not the shipping costs or the return costs.

The refund of the amount will be made once the returned order arrives at our offices and with the same form of payment that has been used: either it will be paid to your credit card or to your PayPal account.


The exercise of the right of withdrawal will extinguish the obligations of the parties to execute the contract.

Without any undue delay and, in any case, no later than 14 days from the date you notify us of your decision to withdraw from the contract. The deadline will be considered fulfilled if you return the goods before the 14-day period has expired.

You will only be responsible for the decrease in the value of the goods resulting from a manipulation other than that necessary to establish the nature, characteristics and operation of the goods.


PRODUCT WARRANTY

The guarantee of the products sold by Flyoutshop is provided and established exclusively by the manufacturer of the product, in the conditions of handling, its correct use and conservation, within the terms contained in the guarantee certificates that are attached to all of them.

All our products have the necessary certificates to be marketed. If you need a certificate, send us an email to; flyoutshop@gmail.com , indicating your order number, name and delivery address. In order to be able to locate the purchased product and send it all the necessary certifications.

The guarantee will start on the same day of delivery and / or acceptance of the order.

The guarantee will be invalidated if the product has been manipulated incorrectly by persons not qualified for the use of our products.

APPLICABLE LEGISLATION. SUBMISSION TO JURISDICTION

The use of our website and product purchase contracts through said website will be governed by Spanish law.

Any controversy that arises or is related to the use of the website or with said contracts will be subject to the non-exclusive jurisdiction of the Spanish courts and tribunals.

If you are contracting as a consumer, nothing in this clause will affect your rights as recognized by current legislation.
